TERMS & CONDITIONS
FOR SERVICE PROVIDERS
1. These terms and conditions govern the relationship between Helped At Home LLC (“Helped at Home”) and the customers of the service (“Customers”). Customers each agree and understand that Helped at Home is a third party service, and that there is no partnership, joint venture, agency, or employment relationship between Helped at Home and Customers. Neither Helped at Home nor Customers will have a right to make any statements or representations or take any actions which are binding on the other without express written consent unless specifically authorized by this agreement.
2. Compensation of Helped at Home We use Customers Referrals and Positive Customers Reviews only as a
selection tool for finding local service providers. We can’t guarantee the
quality of service you will receive at your home. We cannot be held
responsible for any incidents, accidents, or any mishaps that your
selected service providers might cause to you, or to your property or
belongings, while performing a service at your home. It is our objective,
free of charge, to match your service need with a local service provider to
perform a needed service at your home. As our customer, you have an
opportunity to provide feedback to us about received service by clicking
on “Customers Feedback” button through our website,
www.helpedathome.com
3. Indemnity, Waiver, Venue, Governing Law, and Attorney’s Fees
Customer agrees to hold harmless and indemnify Helped at Home for any
conduct or actions by any service provider and acknowledges that Helped
at Home makes no representations or warranties regarding the conduct or
performance of the service provider(s). Helped at Home is not responsible
for any breaches of any agreement or any other conduct or actions by
Service Providers and makes no warranties regarding their performance or
abilities. Helped at Home is not required to provide any refunds based on
major breaches or improper conduct by the service providers. Customer
agrees that Helped at Home’s liability regarding this agreement is limitedto none. Customer fully and completely waives any rights to consequential
damages, punitive damages, or other damages. Customer agrees that
Louisiana law will govern these Terms of Service. Customer agrees that
any lawsuit brought against Helped at Home will be heard in Ascension
Parish Courts, and that the prevailing party in any such suit will be entitled
to an award of reasonable attorneys’ fees incurred in such litigation.
4. Integration and Modification
This Agreement may not be modified except in writing signed by both
customer and Helped at Home. This Agreement contains all the terms
agreed by the parties, and any prior oral or written understandings are
invalid to the extent they are inconsistent with this Agreement.
5. Waiver of Class Action and Trial By Jury
Customer, to the maximum extent allowed by Louisiana law, waives all
rights to bring a class action or representative suit or any suit other than
in customer’s individual capacity. Customer also waives all rights to a jury
trial regarding its relationship with Helped at Home on these Terms and
Conditions.
6. Severability
If any provision of these Terms and Conditions is held illegal or
unenforceable in a judicial proceeding, such provision shall be severed
and shall be inoperative, and, provided that the fundamental terms and
conditions of these Terms and Conditions remain legal and enforceable,
the remainder of these Terms and Conditions shall remain operative and
binding on the Parties.
7. Changes in Terms and Conditions
Helped at Home reserves the rights to make changes to these Terms and
Conditions upon thirty (30) days’ notice to Customer. Customer may
terminate its relationship with Helped at Home if it does not approve of
the changes. Continuance of the relationship with Helped at Home is
consent to the new provisions.
